How the calculation works
In a dismissal without cause, the worker usually receives:
- Salary balance (days worked in the month)
- Proportional 13th and vacation (+ 1/3)
- Prior notice (at least 30 days)
- 40% penalty on the FGTS balance
On resignation, there is no employer-paid notice or FGTS penalty.
Frequently asked questions
Am I entitled to unemployment insurance?
Generally yes in dismissal without cause, depending on tenure. It is not part of this severance total.
